NEW DELHI: The Centre on Friday moved the Supreme Court for initiation of perjury proceedings against PIL petitioner Himanshu Kumar of Vanvasi Chetna Ashram, Dantewada, for misleading the SC by attributing the 2009 killing of tribal villagers to security forces when the Naxals had committed the murders. It sought a CBI/NIA investigation to identify the individuals/organisations “who have been conspiring, abetting and facilitating filing of petitions premised on false and fabricated evidence before the SC as well as before HCs with a motive to deter security agencies from acting against Naxal militia”.
Moved by the pleadings of senior advocate Colin Gonsalves, the SC on February 15, 2010 had asked district judge GP Mittal to record statements of the tribals who were joined as petitioners by Himanshu Kumar. The judge submitted his report on March 19, 2010.
The Centre said surprisingly the report went missing from its records and it had to make numerous failed attempts to procure the same from the SC Registry. Finally, it got a copy after the court ordered so on March 25, 2022, the Centre said. “The district judge in his report said the tribals stated that police were not involved in the crime but those who came from the jungle murdered and brutalised the villagers,” the Centre said.
“The modus adopted in the instant case has become a norm where false petitions are filed by individuals and organisations, who are either supporters of left wing extremism or benefit financially from it,” it said.
